Hearing disputes governed by foreign law by Uzbek courts

Taking into account that the parties to the Agreement are legal persons, in accordance with article 23 of the Commercial Procedural Code of Uzbekistan (CPCU), Uzbek courts competent to hear cases arising from the Agreement would be the economic courts of the Republic of Uzbekistan.

It is important to note that according to article 31 of the CPCU, although parties may contractually choose foreign forum for dispute resolution, Uzbek courts will still have exclusive jurisdiction over the disputes involving issues on transfer of title of real estate, protection of rights and easements arising out of possession of real estate, provided though, that such real estate is located in Uzbekistan.
