Legal System of Uzbekistan

The hierarchy of Uzbekistan law includes: the Constitution of the Republic of Uzbekistan, constitutional laws, codes, ordinary laws, decrees of the President, resolutions and directives of the Cabinet of Ministers, normative acts of ministries and state agencies and so on. The contemporary law of the Republic of Uzbekistan can be situated in the Romano-Germanic legal family.  Court cases are not binding but rather taken into account when issuing independent legal opinions.

 

The Constitution, codes, laws are the superior legislative acts and shall prevail in legal force over by-laws (decrees and resolutions of the President, the Government or state ministries or agencies). Superiority is sometimes shaky and a resolution of the President may have superior “convincing” force notwithstanding inconsistency with some laws.
