Finance Lease Transactions between residents and non-residents

The Finance Lease is possible under Uzbek law and shall be made on the basis of a written agreement between a lessor and lessee. The Finance Lease stipulating the transfer of lease payments in foreign currency outside Uzbekistan to a non-resident lessor shall be qualified a foreign borrowing transaction and, therefore subject to registration with the Central Bank of Uzbekistan (CBU). No lexase payment under the Finance Lease would be allowed unless the Finance Lease agreement is registered by CBU. Registration with CBU takes 20 business days under the law. However, due to novelty of this transaction CBU may take much longer. In our experience we have not come across any finance lease transactions between a resident and non-resident.
