Governing Legislation

Trust management is possible under Uzbek legislation. Although there is no separate general law on trust management of securities in companies, the Civil Code contains a section on trust management of property. Securities and banking legislation also regulate trust operations. There is also “Procedure on Transfer into Trust Management of Shares in State Enterprises” (“Trust Management Law”), Attachment No. 5 to Government Resolution No. 361 dated 22 August 1998. Certain relevant and non-exclusive provisions of the Trust Management Law, in the absence of separate law on trust management of securities in companies, could be applicable to regulation of trust management in general corporate law.
