Laws regulating contractual relations between legal entities and individuals do not define negligence, gross negligence and willful misconduct.

Taking into the account the established business practice, if the breach of contract terms has been committed due to the mentioned reasons then the Debtor will not be exempt from payment of damages and any applicable penalty fees. A mere fact of breach of contract terms may give rise to the liability of the Debtor if otherwise is not stipulated for by contract terms.
