Position of retail depositors vis-a-vis other creditors of a bankrupt bank

In accordance with Article 39 of the Banks Law, retail depositors, who are individuals, shall have priority over other depositors or creditors of an Uzbek bank. Such retail depositors shall be entitled to receive back their money held on deposits regardless of the claims of other depositors or creditors.

Please note, that Article 39 of the Banks Law narrows the scope of application of the priority right to individual depositors only. By individual depositors we mean a depositor, an individual (in Russian: физическое лицо), who has opened a bank deposit for personal purposes rather than for conducting business and in the capacity of an individual rather than of a businessman or otherwise.
