Concept of legal entity

Under Uzbek Civil Code any organization that i) has in its property, business management or operative administration separated assets and ii) is liable with these assets for its undertakings, iii) can acquire and realize corporeal and personal non-corporeal rights on its own behalf, bear the responsibilities and iv) be the plaintiff and respondent in the court -- is treated as a legal entity (Article 39).  Other organizations and units that lack those features are not qualified as a legal entity.  In the Civil Code, the foundation is identified as a non-commercial legal entity (Article 40).  The fund is not referred to in the Civil Code or any other statutes.  Civil Code admits that there may be other forms of legal entities stipulated by legislative acts.  Certain governmental funds are, however, legal entities by virtue of organic ordinances issued by the Government.  In this case, their corporate structure reminds either the structure of a foundation or establishment.
